Manager of Diversity Inclusion - Title VI, ADA

Role Purpose:

Ensures organizational compliance with all civil rights laws and statutes related to employment at Keolis Commuter Services, Title VI program and the ADA. Investigates Title VII (employee) and Title VI (passenger) complaints of discrimination, harassment, and retaliation in compliance with state and federal laws. Provides investigative reports to required authorities (MBTA, MCAD, MassDOT, EEOC). Prepares and presents Title VI reports to MBTA and MassDOT on outreach events, language action initiatives, marketing/advertising to underrepresented employee populations efforts, partnerships with community organizations/groups and employee development and training programs. Leads the Reasonable Accommodation program for employees and passengers that require ADA or religious accommodations in the workplace or on the commuter rail. Trains all new employees, managers, and contractors on EEO compliance, Title VI, VII and ADA laws so that they are aware of their rights and responsibilities as a KCS employee. Develops and implements strategies to prevent the occurrence of harassment and other discriminatory behaviors in the workplace, through information campaigns, training, and outreach. Assists in special projects, including other support functions in the Legal, HR and Customer Service Department as needed.

Knowledge and Experience:

  • 3-5+ years of related experience
  • Bachelor’s degree required and/or equivalent in experience.

Skills:

  • Must be able to communicate successfully in writing and verbally with a variety of disciplines and levels, with both internal and external staff.
  • Extensive familiarity with EEO related discrimination and harassment laws and policies.
  • Excellent interviewing skills. Has completed training in conducting workplace investigations.
  • Excellent interpersonal skills.

Key Accountabilities:

  • Designs and implements investigative procedures and processes for all discrimination complaints, including employee-initiated complaints and passenger civil rights complaints.
  • Responds to and investigates all employee and passenger complaints that allege discrimination and/or harassment.
  • Manages the reasonable accommodation process for employees and passengers in connection with HR and related managers.
  • Performs intake duties for all passenger matters that allege a violation of Title VI or ADA received directly by the Diversity Department.
  • Interviews witnesses, performs research and analyzes data, in order to thoroughly investigate each claim and write up investigative reports.
  • Recommends resolution to employee complaints with authorization from the VP of HR & Training.
  • Works closely with Labor Relations, Human Resources, outside Counsel or internal KCS Counsel as needed on external (MCAD, EEOC) discrimination investigations and resolutions.
  • Maintains a thorough working knowledge of all KCS policies, identifies and makes appropriate referrals for any misconduct discovered during an investigation to other areas and departments.
  • Communicates regularly with MBTA System Wide Accessibility on all passenger ADA related matters.
  • Prepares reports for MBTA on Title VI and ADA complaints, investigations and resolutions.
  • Designs and delivers all civil rights training modules.
  • Conducts a variety of organizational and operations studies and recommends modifications to policies and procedures as appropriate in order to improve diversity and inclusion efforts while remaining in compliance with civil rights laws.
  • Is the SME on Title VI, Title VII and ADA related matters and provides guidance and technical advice to management on all public facing accessibility related codes, regulations and best practices.
  • Using relevant information and individual judgment, determines whether events or processes comply with disability laws, regulations, or standards.
  • Works cross functionally to determine root cause and identify opportunities for operational improvements.
  • Sits on various internal committees to provide advice, counsel and feedback on leave administration, disciplinary, union-related and managerial issues.
  • Evaluates the effectiveness of accessible services, including preparation of reports and recommendations for senior leadership.
  • Establishes and maintains the confidence and support of staff at all levels to advance diversity and inclusion efforts and civil rights compliance; influences culture change by serving as an advocate and resource.
  • May represent Keolis at community events and maintains connections with community organizations that advocate for equity, diversity, and inclusion.
